Terms of Service

1. Acceptance of Terms

By accessing or using the Mizaad platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, donors, beneficiaries, and others who access or use the Service.

2. Use License

Subject to these Terms, Mizaad grants you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Service for personal, non-commercial purposes
• Make donations to verified campaigns
• Create and manage campaigns (if verified as a beneficiary organization)
• View and download receipts for your donations

This license does not include: (a) resale or commercial use of the Service or its contents; (b) distribution, public performance, or public display of any Service content; (c) modifying or making derivative uses of the Service or its contents; or (d) use of data mining, robots, or similar data gathering or extraction methods.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for:

• Maintaining the confidentiality of your password and account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring you log out at the end of each session

We reserve the right to refuse service, terminate accounts, or cancel orders in our sole discretion.

4. Donations

Platform Fee: Mizaad charges a 5% platform fee on all donations to cover operational costs. This fee is clearly disclosed before you complete your donation.

Tax Deductibility: Donations to 501(c)(3) registered organizations may be tax-deductible. You will receive a receipt for your records. Please consult with a tax advisor regarding deductibility.

Refund Policy: All donations are final. Refund requests are considered on a case-by-case basis within 30 days of the donation. Contact our support team for refund inquiries.

Recurring Donations: You may set up recurring monthly donations. You can modify or cancel your recurring donation at any time from your account dashboard.

Fund Distribution: Funds are typically transferred to beneficiary organizations within 3-5 business days after a donation is received, subject to verification and security checks.

5. Campaigns

Eligibility: Only verified registered non-profit organizations may create campaigns on Mizaad. Personal fundraising campaigns are not permitted.

Verification Process: All beneficiary organizations must undergo a thorough verification process including background checks, document verification, and Islamic compliance review (typically 3-5 business days).

Campaign Content: Campaign creators are responsible for the accuracy and truthfulness of all campaign information. Misleading or fraudulent campaigns will be immediately removed and may result in legal action.

Goal Not Reached: If a campaign does not reach its funding goal, all funds raised are still disbursed to the beneficiary organization. Mizaad does not operate on an "all-or-nothing" model.

Updates: Campaign creators are expected to provide regular updates to donors about the progress and impact of their campaigns.

6. Intellectual Property Rights

The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Mizaad and its licensors.

By submitting content to the Service (including campaign descriptions, images, and updates), you grant Mizaad a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and promoting the Service.

You retain all rights to any content you submit and are responsible for ensuring you have all necessary rights and permissions to submit such content.

7. Prohibited Uses

You may not use the Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload viruses or any other type of malicious code
• To collect or track the personal information of others
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• For any obscene or immoral purpose
• To interfere with or circumvent the security features of the Service

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Mizaad does not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements

Mizaad acts as a platform connecting donors with beneficiary organizations. We verify organizations to the best of our ability but do not guarantee the actions or conduct of beneficiaries or the accuracy of campaign information.

9. Limitation of Liability

IN NO EVENT SHALL MIZAAD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
